Scott Brian Odell, 34, in case 25-CR-82, pled guilty to counts one/two/three/four (merged) class A misdemeanor driving under the influence second offense and was sentenced to 11 months and 29 days in the Chester County Jail, receiving credit for time served pretrial, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs, all suspended and supervised, zero days incarceration to be served prior to release on probation or Community Corrections, and ordered to pay all court costs plus $600 in fines, and to complete 48 hours of unpaid community service work. He pled guilty to count five, class D felony aggravated assault – reckless, and was sentenced to four years in a TDOC facility at 30% service prior to release eligibility, receiving credit for time served, all suspended and supervised and ordered to pay costs plus $1,000 in restitution, and ordered to complete 48 hour of unpaid community service. He pled guilty to count six, class C misdemeanor open container and was ordered to pay a $10 fine. Odell pled guilty to count seven, class C misdemeanor drivers to exercise due care, and was sentenced to 30 days in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. He pled guilty to count eight, class D misdemeanor failure to yield right of way and was sentenced to 30 days in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. He pled guilty to count nine, class C misdemeanor obedience to any required traffic control device and was sentenced to 30 days in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. All counts are concurrent. It is not the intent of the court for duplication of Jail Credit to be applied to consecutive sentences. He is to be released on time served, the balance of the four-year sentence suspended to be supervised by State Intensive Probation, no work release, no post-plea expungement, must maintain full-time employment or be a full-time student, must submit to an alcohol and drug evaluation and follow recommendations, must submit to random monthly drug and alcohol screens, must complete DUI Safety School and MADD Victim Impact Panel within six months. Driving privileges are revoked for a period of one year – Ignition Interlock required for a restricted license during revocation period if eligible, must continue to participate in mental health treatment and follow all recommendations as a condition of probation.
