NOTICE OF FORECLOSURE SALE
22 acres Cave Springs Road
WHEREAS, on November 21, 2024, Domenica Thompson, executed and delivered a Deed of Trust, in favor Jay L. Johnson, as Trustee, to secure a promissory note in the amount of $155,000.00 described therein, the same being payable to the beneficiary, Elegment LLC, a Texas series limited liability company, with said Trust Deed being of record in the Register’s Office of Chester County, Tennessee, in Record Book 525 Page 324 on December 6, 2024 to which reference is hereby made (the “Deed of Trust”); and
WHEREAS, Jay L. Johnson, as Trustee, was unwilling or unable to act as Trustee under the Deed of Trust, and Jerry P. Spore has been appointed Substitute Trustee, by Elegment LLC, as the owner and holder of the Note by an instrument of record as Record Book 542 Page 48 in the Register’s Office for Chester County, Tennessee; and
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, Elegment LLC, as the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust; and
WHEREAS, the Substitute Trustee conducted a diligent search of the Defense Manpower Data Center (DMDC) website for each known borrower in compliance with the Service Members Civil Relief Act (SCRA) and determined that borrower were 1) not members of the Armed Forces of the United States of America and had not been members of any such service or force for at least twelve (12) months prior to the date of the foreclosure sale or 2) were members of the Armed Forces of the United States of America at the time that the security agreement was executed and as such, the foreclosure and sale of this property is not subject to the SCRA provisions of 50 USC § 501 et. seq.; and
NOW THEREFORE, notice is hereby given that I, Jerry P. Spore, Substitute Trustee or Trustee, pursuant to the power, duty, and authority vested in and conferred upon me, by the Deed of Trust, will on Friday, February 20, 2026, at 11:30 a.m. at the customary door of the Chester County Courthouse located at Henderson, Tennessee, offer for sale to the highest bidder for cash, certified check, or cashier’s check, and free from all legal, equitable, and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Chester County, Tennessee, described as follows:

Beginning at a cotton picker spindle found in the centerline intersection of Cave Springs Road and Laurel Hill Road; thence with the centerline of Laurel Hill Road and a curve to the left having an arc length of 202.50 feet, a radius of 1161.04 feet, and a chord length of 202.24 feet bearing South 52 degrees 01 minutes 24 seconds West to a cotton picker spindle set in the eastern boundary line of Gary Keith Higginbotham (Deed Book 144, Page 298), said point being located North 02 degrees 30 minutes 11 seconds East 203.44 feet from an iron rod found; thence leaving said road and with the eastern boundary line of Higginbotham North 02 degrees 30 minutes 11 seconds East 58.39 feet to an iron rod found in a gravel parking area at the northeast corner of Higginbotham; thence with the northern boundary line of Higginbotham, then Gary Keith Higginbotham (Deed Book 183, Page 43), Leonard Jones (Deed Book 90, Page 389), Ronald D. Rowland (Deed Book 90, Page 656), and Chad Beecham (Deed Book 191, Page 55) North 87 degrees 56 minutes 15 seconds West 2627.28 feet to an iron rod found at an interior corner of Beecham and the southwest corner of the herein described tract; thence with the eastern boundary line of Beecham North 02 degrees 32 minutes 26 seconds East 363.30 feet to an iron rod set (all iron rods referred to as set herein are ½ inch by 18 inches with plastic identification cap stamped “SLS INC RLS2148, PLS 2929); thence, with a new severance line East 1882.97 feet to a cotton picker spindle found in the center of Cave Springs Road; thence with said centerline South 63 degrees 57 minutes 54 seconds East 569.54 feet to a point; thence continuing on with said centerline and a curve to the left having an arc length of 334.90 feet, a radius of 2125.97 feet, and a chord length of 334.56 feet bearing South 67 degrees 42 minutes 54 seconds East to a point; thence continuing on with said centerline and a curve to the left having an arc length of 63.74 feet, a radius of 4368.89 feet, and a chord length of 63.74 feet bearing South 76 degrees 49 minutes 32 seconds East to the point of beginning. Containing 22.00 acres as surveyed by Superior Land Surveying, Inc. RLS 2148.
Being the same property conveyed to Domenica Thompson from Elegment LLC by Warranty Deed of record in Record Book 525 Page 319 recorded on December 6, 2024, in the Register’s Office of Chester County, Tennessee.
The property address is Cave Springs Road, Henderson, Chester County, Tennessee.
All right and equity of redemption, statutory and otherwise, homestead and dower, are expressly waived in the said Deed of Trust. Title is believed to be good, but the Substitute Trustee will make no covenant of seisin, marketability of title or warranty of title express or implied and sell and convey only as Substitute Trustee.
The property shall be sold AS IS, WHERE IS AND WITH ALL FAULTS and without any representations or warranties of any kind whatsoever, whether express or implied
The sale of the property shall be made subject to any and all prior liens, encumbrances, deeds of trust, easements, restrictions, building lines, unpaid taxes and assessments (plus penalty and interest, if any) and matters of record, plus any and all other matters and encumbrances superior in right to the lien of the Deed of Trust. Further, such sale is also subject to any matter that on site inspection or accurate survey of the property might disclose.
The Substitute Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale and further, reserves the right to adjourn the day of sale to another day certain without further publication, upon announcement at the time set forth above.
